Jenkins P.C. - High Net Worth Divorce

Are You In A Domestic Violence Situation?

The California Department of Justice reports that there are over 160,000 calls to law enforcement each year regarding domestic violence. No one should have to suffer through these ordeals, and no matter the situation, there is a way out.

Divorces involving domestic violence are often overwhelming and filled with anxiety. Attorney Erik Jenkins will do everything in their power to protect you and make you feel secure through the entire process of your divorce. Acts of domestic violence are inexcusable, and we feel responsible for bringing your situation to justice.

The Facts Of Domestic Violence

The Family Code of California characterizes domestic violence to include but are not limited to:

  • The use of force to injure
  • Threats of physical violence
  • Sexual assault
  • Harassment
  • Verbal or emotional abuse

Any of these acts can lead to serious physical, emotional and mental trauma not only for the person suffering such mistreatment, but also the whole family unit. Nevertheless, people in these situations often find it very difficult to leave. They may not want to separate their family, or they may fear retribution.

Obtaining A Restraining Order

In the event of domestic violence, police officers can issue emergency protective orders to protect you and your family from the perpetrator, generally for a short period of time. Family courts can issue domestic violence restraining orders protecting you and members of your family for up to five years from the perpetrator.

We are always ready to help clients with the process of:

  • Completing restraining order forms to submit to court
  • Serving these papers to the restrained party
  • Supporting you through the court hearing and afterward

You can learn more about whether seeking a restraining order is the right decision for you on our FAQ page.
